SUB-COMMITTEE ON DECOMMISSIONING
_Terms of reference as set out in Joint Paper on Opening Scenario_
To secure implementation of all aspects of the report of the International Body, including:
(a) agreement on the modalities of decommissioning on the basis of the guidelines contained in paragraphs 36 to 50 of the Report of the International Body;
(b) advice to both Governments, in the light of those discussions on the legislative and practical implications of the course which is recommended; and
(c) agreement on any other arrangements necessary for implementation of the Report.

Discussion of
- Mitchell proposals on modalities of decommissioning; - verification: possible role and composition of an independent commission; - [consideration of detailed legislative requirements in both jurisdictions]; - phasing and sequencing of decommissioning; - time of decommissions - arrangements for the start of physical decommissioning during the negotiations; - other matters which participants regard as relevant.
_Possible Compromise_
The suggestion below is an attempt to give flesh to a possible compromise consistent with the approach which would see a sub-committee work in parallel with negotiations in the three strands but also taking up the suggestion contained in contacts yesterday that a more substantial agenda for the proposed sub-committee and greater particularity. It has been prepared with a view to securing agreement next week on the proposals contained in the 25 July paper. If that is not possible and the proposal to establish a working party to meet in advance of Plenary reconvening gains momentum, it would most appropriately be tabled at some point in the negotiations _within_ that working party. The approach does not envisage publication of draft legislation in advance of the establishment of the sub-committee. Underlined material is a development of the existing remit and material in square brackets the potentially more sensitive items. Paragraph number refer to the International Body's Report.
(a) agreement on the modalities of decommissioning on the basis of the guidelines contained in paragraphs 36 to 50 of the Report of the International Body _with reference, in particular to:_
: _the method or methods to be adopted_ (paragraph 43); : _the composition and role of an independent commission_ (paragraph 40);
(b) advice to both Governments, in the light of those discussions on the legislative and practical implications of the course which is recommended, _to include_
: _consideration of draft legislative proposals to be tabled by both Governments to enable the Report of the International Body to be given effect in their respective jurisdictions; and_
: _any further measures necessary for the operationalisation of the method or methods of decommissioning decided upon in accordance with paragraph (a) above;
(c) agreement on any other arrangements necessary for implementation of the Report, _[to include_:
