Wyoming State Constitutional Convention 1889

The Wyoming Constitution Convention began September 2, 1889 without the authorization from an enabling act. The articles were individually voted on, creating the final Constitution of Wyoming on September 30, 1889. It was later ratified on November 5, 1889.

Section. 1. There shall be established and maintained the office of Inspector of Mines, the duties and salary of which shall be prescribed by law. When said office shall be established, the governor shall, with the advice and consent of the senate, appoint thereto a person proven in the manner provided by law to be competent and practical, whose term of office shall be two years.

Sec. 2. The legislature shall provide by law for the proper development, ventilation, drainage and operation of all mines in this state.

Sec. 5.

For any injury to person or property caused by willful failure to comply with the provisions of this article, a right of action shall accrue to the party injured for the damages sustained thereby, and in all cases in this State whenever the death of a person shall be caused by wrongful act, neglect or default, such as would if death had not ensued have entitled the party injured to maintain an action to recover the damages in respect thereof, the person who or the corporation which would have been liable if death had not ensued, shall be liable to an action for damages notwithstanding the death of the person injured, and the legislature shall provide by law at its first session for the manner in which the right of action in respect thereto shall be enforced.
