The Convention considers the Committee of the Whole report on Propositions Number 34, 142, 25, 109, 81, 36, 38, 77, 49, 42, 46, 128, 30, 111, 51, 117, 84, 32, 87, 85, and the Resolution from the Common Council of Phoenix and agrees with the Committee recommendation to indefinitely postpone. The Convention considers the Committee of the Whole report on Substitute Propositions Number 107, 140, 103, and Substitute Section 7 of Substitute Proposition Number 33 and agrees with the Committee recommendation to pass the propositions as amended. The Substitute Propositions are referred to the Committee on Style for engrossment.

No. 117.

A Proposition Relative to Bribery and Corruption.

IT IS HEREBY PROPOSED:

Section 1. The offense of corrupt solicitation of members of the legislature, or of public officers of the State, or of any municipal division thereof, and any occupation or practice of solicitation of such members or officers, to influence their official action, shall be defined by law, and shall be punished by fine and imprisonment.

Section 2. Any person or corporation who shall directly or indirectly offer; give or promise any money or things of value, testimonial, privilege, or personal advantage to any executive or judicial officer or member of the legislature, to influence him in the performance of any of his public or official duties, shall be deemed guilty of bribery, and be punished in such manner as shall be provided by law.

Section 3. Any person holding office under the laws of this State, who, except in payment of his legal salary, fees or perquisites, shall receive or consent to receive, directly or indirectly, anything of value or of personal advantage, or the promise thereof, for performing or omitting to perform any official act, or with the express or implied understanding that his official action or omission to act is to be in any degree influenced thereby, shall be deemed guilty of a felony. This section shall affect the validity of any existing statute in relation to the offense of bribery.

Section 4. Any person or corporation offering money or other thing of value, either directly or indirectly, for the purpose of influencing any voter for or against any measure or candidate in any election, shall be deemed guilty of bribery.

Section 5. Any person charged with receiving a bribe, or with offering or promising a bribe, shall be permitted to testify in his own behalf in any civil or criminal prosecution therefor.

Section 6. Every person shall be disqualified from holding any office of profit in this State who shall have been convicted of having given or offered a bribe to procure his election or appointment.
