JOINT RESOLUTION

Proposing an amendment to the Constitution of the United States.

Be it resolved by the Senate and House of Representatives of the United States of America in Congress assembled, (two-thirds of both houses concurring,) That the following article be proposed to the legislatures of the several States as an amendment to the Constitution of the United States, which, when ratified by three-fourths of said legislatures, shall be valid as part of the Constitution, namely:

ARTICLE —.

SEC. 1. All persons born [+e897139]or naturalized [+e898770]in the United States[+e897139],[+e898285] and subject to the jurisdiction thereof[+e897139],[+e898285] are citizens of the United States and of the State[+e897139]s[+e897139 -e898285] wherein they reside. [+e897139]No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

SEC. 2. Representatives shall be apportioned among the several States which may be included within this Union[-e898525] according to their respective numbers, counting the whole number of persons in each State, [-e898701]excluding Indians not taxed. SEC. 3.[+e897145]N[+e898420]That n[+e898317 -e898420] [+e897145 -e898317]No person shall be a Senator or Representative in Congress, or[+e897145] an[+e897145 -e898317] elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oat[+e897145],[+e898317]h as a member of Congress, or as an officer of the United States, or as a member of any State Legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the e[+e897145]validity [+e898764]n[+e897145]f the pu[+e898764]emi[+e897145]c debt[+e898764]es th[+e897145 -e898764], [+e898368 -e898764]excepting those who h[+e898368], authoriz[+e898764]ave dul[+e898368 -e898764]y r[+e898368]by law, [+e898764]ec[+e898368]clud[+e898764]eived par[+e898368 -e898764]don [+e898368]debts [+e898764]an[+e898368]c[+e898764]d[+e898368 -e898764] amn[+e898368]d for payment[+e898764]esty under the Const[+e898368 -e898764]itut[+e898368]pensions and[+e898764]ion and laws, and will take [+e898368 -e898764]such oath [+e898368 -e898381]f[+e898764]as [+e898368 -e898381]services in suppressing insurrection or rebellion[+e898764]shall be required by law[+e898368 -e898764]e[+e897145 -e898764]reo[+e897145]. [-e897111]The obligations of the United States incurred in su[+e897148]p[+e897148 -e898764]pr[+e897148]e[+e897148 -e898764]ssing insurrection[+e897148], or in [+e897148 -e898765]defense of the Union, or [+e897148]for[+e898764]for payment o[+e897148 -e898764]f bounties or pensions incident thereto, shall remain inviolate. SEC. [+e897148]5[+e897149]4[+e897148 -e897149]. [+e897148]Until the fourth day of July, in the year one thousand [-e897111]5[+e898764]e[-e898764]ight hundred and seventy, a[-e897111]ll perso[-e897149]ns who v[-e897111]oluntaril[-e897149]on account of[+e898413]y adhered to the lat[-e898413]e insurr[-e897149]ection, giving it aid an[-e897111][[+e897149]d [-e897111]] rebellion[+e897149]comfort[-e897149], shall be excluded from the right to vote for representatives[-e897111]the [+e897149] in Co[-e897111]r emancipation of any slave; but all such debts, obligations, and claims shall b[+e897149]ngress and for elect[-e897149]or[-e897111]f[+e897149]s [-e897111]ever held illegal and void[+e897149]for Pr[-e897149]esident an[-e897111]6[+e897149]d[-e897149] Vice President of the United States. SEC. [-e897111]4. Neither the United States nor any State shall assume or pay any debt or obligation already incurred, or which may hereafter be incurred, in aid of insurrection or of war against the United States, or any claim for compensation for loss of involuntary service or labor.

SEC. 5. The Congress shall have power to enforce by appropriate legislation the provisions of this article.
