JOINT RESOLUTION

Proposing an amendment to the Constitution of the United States.

Be it resolved by the Senate and House of Representatives of the United States of America in Congress assembled, (two-thirds of both houses concurring,) That the following article be proposed to the legislatures of the several States as an amendment to the Constitution of the United States, which, when ratified by three-fourths of said legislatures, shall be valid as part of the Constitution, namely:

ARTICLE —.

SEC. 1. All persons born in the United States[+e897139],[+e898285] and subject to the jurisdiction thereof[+e897139],[+e898285] are citizens of the United States and of the State[+e897139]s[+e897139 -e898285] wherein they reside. [+e897139]No State shall make or enforce any law which shall abridge the privileges or immunities of persons born in[+e897074]citizens of[-e897074] the United States or naturalized by the laws thereof[+e897074]; nor shall any State deprive any person of life, liberty, or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

SEC. 2. No class of persons as to[+e897074]Representatives shall be apportioned among[-e897074] the right of any of whom to suffrage discrimination shall be made, by any[+e897074]several States which may be included within this Union according to their respective numbers, counting the whole number of persons in each[-e897074] State, shall be in[+e897074]ex[-e897074]cluded in the basis of representation, unless such discrimination[+e897074]ing Indians not taxed. But whenever in any State the elective fr[-e897074]anchi[-e897111]s[-e897074]e [-e897111]sha[-e897074]ll[-e897111] be in v[+e897074]irtu[+e897074 -e897111]e[+e897074]denied to any[-e897074] portion of i[-e897111]mpartial qualifications founded on i[+e897074]ntell[+e897074 -e897111]igence or[+e897074] prop[+e897074 -e897111]erty[+e897074]ts male citize[-e897074]ns no[-e897111]t less [-e897074]3.[+e897145]N[+e898420]That n[+e898317 -e898420] [+e897145 -e898317]No person shall be a Senator or Representative in Congress, or[+e897145] an[+e897145 -e898317] elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oat[+e897145],[+e898317]h as a member of Congres[+e897145]inhabitants, being of the United States,[+e898327]s, or as an officer of the United States, or as a member of any State Legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereo[+e897145]. SEC. [+e897145]The obligations of the United States incurred in suppressing insurrection, or in defense of the Union, or for payment of bounties or pensions incident thereto, shall remain inviol[+e897148] in such State[+e898330]5[+e897149]ate. [+e897148]

SEC. 3. [+e897074 -e898413]The public debt of[+e897074], the basis of representati[-e897074]the [+e897149]on in [-e897074]r emancipation of any slave; but all such debts, obligations, and claims shall b[+e897149]such State shall be [-e897149]re[-e897074]f[+e897149]du[-e897074]ever held illegal and void[+e897149]ced in[-e897149] the United States, including [+e897074]proportion which the number of male citizens sh[-e897074]al6[+e897149]l debts or obligations which have been or m[+e897074]bear to the whole number of such male citizens not less than twenty-one years of age. SEC. 3. Until the fourth d[-e897074]ay of July, in t[-e897074]her[+e897074] y[-e897074]eafte[+e897074]r be incur[+e897074]one thousand eight hund[-e897074]red in suppressing[+e897074]and seventy, all persons who voluntarily adhered to the late[-e897074] insurrection or in carrying on war in defense of[+e897074], giving it aid and comfort, shall be excluded from[-e897074] the Union, or[+e897074]right to vote[-e897074] for payment of bountie[+e897074]representatives in Congress and for elector[-e897074]s f[-e897074]or pensions inc[+e897074]President and Vice Pres[-e897074]ident to such war and provided for by law,[+e897074]of the United States. [-e897074]

SEC. 4. Neither the United States nor any State[-e897074] shall be inviolable. But[+e897074]assume or pay any[-e897074] debts[+e897074] or obligations which have been[+e897074] already incurred,[-e897074] or which [-e897074]may hereafter be incurred,[-e897074] in aid of insurrection or of war against the United States, or [-e897074]and[+e897074]y[-e897074] claims of[+e897074] for[-e897074] compensation for loss of involuntary service or labor, shall not be assumed or paid by any State nor by the United States[+e897074].

SEC. 4[+e897074]5[-e897074]. The Congress shall have power to enforce by appropriate legislation the provisions of this article.
