A PROPOSITION.
No. 68.
Introduced by Mr. Lynch of Graham County.
A Proposition Relative to Criminal Prosecutions.
It is hereby proposed:
Section 1. No person shall be prosecuted criminally in any court of record for felony or misdemeanor otherwise than by information or indictment; no person shall be prosecuted for felony by information without having had a preliminary examination before a magistrate or having waived such preliminary examination. Prosecution may be instituted in courts other than courts of record upon sworn complaint.
Section 2. Grand juries shall be drawn and summoned only by order of the superior court.
