No. 58.

Introduced by Mr. Coker of Pinal County.

A Proposition Relative to Corporation Commission.

It is hereby proposed:

Section 1. There is hereby established a Corporation Commission, to be composed of three persons.

Section 2. The corporation commission shall have general supervision of all private corporations doing business in this State, to be exercised in such manner as may be provided by law, and shall be the custodian of all articles of incorporation, reports, and other papers and documents, required to be filed by or on behalf of corporations in any public office, and have the sole power to issue certificates of incorporation to companies organizing in the State, and permits to foreign corporations to do business therein.

Section 3. All private corporations engaged in carrying persons or property for hire; or in furnishing electricity for light or power; or in furnishing water for irrigation, fire protection or other public purposes; or in furnishing hot or cold air or steam for heating or cooling purposes for profit; or in transmitting messages or furnishing public telegraph or telephone service; and all private corporations having or exercising the right of eminent domain, shall be deemed public service corporation.

Section 4. The corporation commission may prescribe reasonable maximum rates and charges to be made and collected by public service corporations within the State for service therein, and make reasonable rules and regulations by which such corporations shall be governed in the transaction of business within the State, and may prescribe the forms of contracts to be used by such corporations in transacting such business, and make and enforce reasonable orders, rules and regulations for the convenience, comfort, and safety, and the preservation of the health, of the servants and patrons of such corporations.

Section 5. The corporation commission shall have power to inspect and investigate the property, books, papers, business, methods and affairs of any corporation doing business within the State, and for the purpose of the commission and the several members thereof shall have the power of a court of general jurisdiction to enforce the attendance of witnesses and production of evidence by subpoena, attachment and punishment, and which said power shall extend throughout the State.

Section 6. The legislature may by law authorize municipalities to exercise supervision over public service corporation doing business therein, including the regulation of rates and charges to be made and collected by such corporations.

Section 7. The legislature may enlarge the powers and extend the duties of the corporation commission, and shall prescribe rules and regulations to govern proceedings instituted by and before it; but until such rules and regulations are proved by law the commission may make rules and regulations for such purposes.
