No. 57.

A Proposition Relative to Official Fees and Salaries

Introduced by Mr. Coker of Pinal County.

It is hereby proposed:

Section 1. Notaries public may collect and retain such fees as may be prescribed by law. Justices of the peace and constables may collect and retain such fees as may be prescribed by law until otherwise provided by the controlling boards or councils of the respective counties, villages and cities wherein they are chosen.

Section 2. No public officer, or deputy, assistant or employee of such officer, other than a notary public, justice of the peace or constable, shall ever be permitted to collect and retain any fee on any pretense; but all public officers, their deputies, assistants and employees, to whom compensation is allowed, shall receive fixed salaries, and shall account for and pay over all fees collected by them to the legal custodians of such funds.

Section 3. Members of the legislature shall receive annual salaries, Senators $600, and Representatives $500, and their actual traveling expenses in going to and returning from the Capital once for every regular and once for every extraordinary session; but they shall not receive any such expenses when attending a session appointed by themselves, and they shall not receive any other sum on any account.

Section 4. The legislature shall fix the salaries and the compensation of public officers and employes when payable out of the State treasury; and shall also fix the salaries of the members of the controlling boards of counties and the mayors and councilmen of villages and cities.

Section 5. The controlling board of every county shall fix the compensation of all officers except its own members and of all persons, payable out of the country treasury; and the mayor and councilmen shall fix the compensation of all officers except themselves, and of all persons, payable out of the village or city treasury; and the controlling officers of any district shall fix the compensation of officers and persons payable out of the funds of the district.

Section 6. The authority by which any official salary is fixed may enlarge or reduce the same at any time, making the change effective from the end of the term of office then existing.

Section 7. The salaries of officers chosen for the first time under authority of the State may be fixed at any time prior to the expiration of the terms of such officers.
