Memorial of James Lindsay, Contesting the Right of John G. Scott to represent the 3d congressional district of Missouri.

To the House of Representatives, Washington City, D. C.:

The undersigned, your memorialist, most respectfully represents that a vacancy was occasioned in your body by the death of the Hon. John W. Noell, who was elected a member of the 38th Congress from the third district of Missouri; that the governor of Missouri issued his proclamation ordering a special election in said district on the 3d day of August, 1863, to supply said vacancy, and a certificate of election has been issued to John G. Scott.

I notified Mr. Scott of my intention to contest his right to represent the district, and if granted a hearing, will be able to show that I am the legally elected representative from the third congressional district of Missouri, having received a majority of all the legal votes cast at said special election.

I therefore respectfully ask that the evidence already taken in the case, and now being taken, be referred to the Committee of Elections as fast as it is received by the Clerk.
