Memorial on Missouri Contested Election: Mr. Bruce

Memorial of John P. Bruce, contesting the election of the honorable Benjamin F. Loan, of the seventh congressional district, in the State of Missouri.

To the House of Representatives of the Congress of the United States:

The undersigned, John P. Bruce, respectfully represents, that at the election for representatives in the thirty-eighth Congress of the United States, held in the State of Missouri, on the fourth day of November, 1862, Benjamin F. Loan and himself were candidates in the seventh congressional district of that State; that upon the return, filed in the office of the secretary of state, the said Benjamin F. Loan has received a certificate of election, and now holds a seat in your body by virtue thereof. The undersigned further represents that the said election was not held in conformity to the Constitution of either the United States or the State of Missouri, and that he, and not the said Benjamin F. Loan, received a larger number of votes, legally cast, in the counties of said district, where the election was held in conformity to the laws and Constitution of the United States and the State of Missouri, at that election than the said Benjamin F. Loan, and is, therefore, entitled to the seat now occupied by said Loan, as the representative of the said district in the thirty-eighth Congress.

He also states that, in pursuance of the requirements of the act of February 19, 1851, regulating contested elections, he served duly a notice of contest upon the said Benjamin F. Loan, setting forth specifically the grounds thereof; that answer was received and testimony taken under the provisions of said act, which notice, answer, and testimony, with documents relating to the contest, and other testimony, have been duly transmitted to the clerk of the House of Representatives, and are now in his possession.

Wherefore, referring to the notice and other papers as a part of this memorial, the undersigned asks that the subject may be inquired into by the House, according to the Constitution and the laws, and the usual course of proceeding, on the part of the House, in like cases, and that he maybe declared entitled and be admitted to a seat in the House, as a member thereof, duly elected from the seventh congressional district of Missouri, to the thirty-eighth Congress.
