Wyoming State Constitutional Convention 1889

The Wyoming Constitution Convention began September 2, 1889 without the authorization from an enabling act. The articles were individually voted on, creating the final Constitution of Wyoming on September 30, 1889. It was later ratified on November 5, 1889.

Sec. 1. All State, County, City, Town, and School officers, (excepting Justice of the Peace and Constables, in Precincts, having less than fifteen hundred population, and excepting Court Commissioners, Boards of Arbitration and Notaries Public) shall be paid fixed and definite Salaries. The Legislature shall from time which fix the amount of such Salaries as are not already fixed by this Constitution, which shall in all cases be in proportion to the value of the service rendered and the duty performed.

Sec. 2. The Legislature shall provide by Law the fees, which may be demanded by the Justice of the Peace and Constables in Precincts, having less than fifteen hundred population, and of Court Commissioners, Boards of Arbitration, and Notaries Public which fees the said officers shall accept as their full compesation. But all other State, County, City, Town and School officers shall be required by Law to keep a true and correct account of all fees collected by them, and to pay the same into the proper Treasury when collected. Provided that in addition to the salary of sheriffs they shall be entitled to receive from the party for whom the services are rendered in civil cases such fees as may be prescribed by law.

Sec. 3. The Salaries of County officers shall be fixed by Law within the following limits to wit:

In Counties having an assessed valuation not exceeding $2,000,000

The Sherriff shall be paid not more than Fifteen hundred Dollars per year.

The County Clerk shall not be paid more than Twelve Hundred Dollars per year.

The County and Prosecuting Attorney shall not be paid more than Twelve hundred per year.

The County Treasurer shall not be paid more than One Thousand Dollars per year.

The County Assessor shall not be paid more than One Thousand Dollars per year.

The County Superintendent of Schools shall not be paid more than five hundred Dollars per year.

In Counties having an assessed valuation of more than $2,000,000 and not exceeding $5,000,000

The Sherriff shall not be paid more than Two Thousand Dollars per year. ($2000)

The County Clerk shall not be paid more than Eighteen hundred Dollars per year ($1800)

The County and Prosecuting Attorney shall not be paid more than Fifteen hundred per year. ($1500)

The County Treasurer shall not be paid more than Fifteen hundred dollars per year ($1500)

The County Assessor shall not be paid more than Twelve hundred dollars per year. ($1200)

The County Superintendent of Schools shall not be paid more than Seven hundred and fifty Dollars per year ($750)

In Counties having more than $5,000,000 assessed valuation,

The Sherriff shall not be paid more than ($2000) Two Thousand Dollars per year,

The County Clerk shall not be paid more than Two Thousand Dollars per year ($2000)

The County Treasurer shall not be paid more than Two Thousand Dollars per year ($2000)

The County and Prosecuting Attorney shall not be paid more than Twenty five hundred per year. ($2500)

The County Assessor shall not be paid more than Fifteen hundred dollars per year ($1500)

The County Superintendent of Schools shall not be paid more than One Thousand Dollars per year ($1000)

The county surveyor in all counties shall receive not more than eight dollars per day for each day actually engaged in the performance of the duties of his office.

Sec. 4

. The legislature shall provide by general law for such deputies as the public necessities may demand, and fix a reasonable compensation therefor.

Sec. 5. Any county officers performing the duties usually performed by the officers named in this article shall be considered as referred to by section 3 of this article, regardless of the title by which their offices may hereafter be designated.
