Proposition Relative to Militia [File No. 72]

Militia

Sec. 1-. The militia of the State of Utah shall consist of all able-bodied male residents of this State between the ages of twenty-one and forty-five, except such persons as now are or hereafter may be exempted by the laws of the United States or of this State.

Sec. 2-. No person conscientiously opposed to bearing arms shall be compelled to do military duty; but such persons shall pay an equivalent for exemption, the amount to be prescribed by law.

Sec. 3-. The Legislature shall provide by law for … and disciplining the militia or the State. Such… not incompatible with the constitution … laws or the United States ..or the constitution of this state.

Sec. 4-. The Legislature shall provide for calling forth the militia to execute the laws of the State, to suppress insurrection and repel invasion.

Sec. 5-. Officers or the militias shall be elected or appointed and be commissioned in such manner as may be provided by law.
