Wyoming State Constitutional Convention 1889

The Wyoming Constitution Convention began September 2, 1889 without the authorization from an enabling act. The articles were individually voted on, creating the final Constitution of Wyoming on September 30, 1889. It was later ratified on November 5, 1889.

Sec 1, Public Office

Every Railroad or Telegraph Company Corporation organized or doing business in this state, under the laws thereof, or of any other states or territory of the United States, shall have and maintain an office or place of business in this state for the transactions of its business, where a correct list of all of its stock holders and the amount of stock, by number of shares and per value of each share, shall be kept and where trans. fees of stock shall be made, and in which shall be kept books, which shall be open for inspection by officers or persons authorized by law to inspect the same, in which shall be recorded the amount of certified stock subscribed and the amount actually paid in, the amount of its assets and liabilities and such other valuable information as may be by the laws of this state require.

Sec. 2, Reports

The Directors of every Railroad and Telegraphy Company Corporation, or other officers or persons having control of its business affections, or the management thereof, shall annually make a report, under oath to the audition of public accounts, or such other officers of the state as may be designated by law, of the amount required from passengers and freight and of such other matters as may be required by law.

Sec. 8, Eminent Domain

The exercise of the power and right of eminent domain shall ever be so construed or abridged as to prevent the taking of the property and franchises of Railroad and Telegraph companies or corporations already organized or that may be hereafter organized and subject the same to public use or necessity in the same manner and to the same extent as the property of individuals.

Sec. 9, Abuses

The legislature shall have power to exact laws to correct on present abuses, unjust discrimination and extortion in all changes of Railroad, Express and Telegraph companies or corporations

Sec. 11, Laws to Regulate

The legislature shall enact such laws as are requisite and necessary to carry out the to carry out the provisions of this article.
