Wyoming State Constitutional Convention 1889

The Wyoming Constitution Convention began September 2, 1889 without the authorization from an enabling act. The articles were individually voted on, creating the final Constitution of Wyoming on September 30, 1889. It was later ratified on November 5, 1889.

Railroads

Article 15 Railroads

Sec I

All railroads in this state shall be public highways, and shall be common carriers. Any association, or corporation organized for the purposes shall have the right to construct and operate a railroad between any points in this state. And to connect at State lines with railroads of other States. Every railroad company shall have the right with its road to intersect, connect with or cause any other railroad; and shall receive and transport each others passenger, towage, and cars loaded or empty, without delay or discrim-ination. Every railroad corporation organized in this State shall maintain an office therein where transfers of its stock shall be made, and where its books shall be kept for inspection by any stockholder or creditor of such corporation. In which shall be recorded the amount of the capital stock subscribed or paid in, and by whom, the names of the owners of its Stock and the amounts owned by them, respectively, the transfers of said stock, and the names and places of the residences of its officers.

Sec II

All individuals, associations and corporations shall equal rights to have persons and property transported over railroads, and no undo or unreasonable dis-crimintaion shall be made in charges for, or infacil-ities for, transportation of freight or passengers within this State, or coming from or going to any other State. Persons or property transported over railroads shall be delivered at any station at charges not xceeding the charges for transportations of persons or property of the same class in the same direction to anymore district station; but xcursion and commutation tickers may be issued at special rates.

Sec III

No railroad or other corporation or the lesees of any Railroad shall consolidate the stock, property or franchizes of such corporation, with, or lease or purchase the works of francizes of, or in any way control any other railroad corporation owning or having under its control a parallel or competing line. Nor shall any officer of such railroad corporation as an officer of any other railroad corporation or having control of a parallel or competing line; and the question whether railroads are parable or competing lines shall when demanded by the party complain out, be decided by a jury as in other civil issues.

Sec IV

No Incorporated company doing business of a comon carrier shall prosecute or engage in moving or manufacturing articles for transportation over its works; nor shall such company, directly or indirectly engage in any business xcept that of common carriers or hold or acquire lands, freehold, or leasehold xcept such as shall be necessary for carrying on its business; but mining or manufacturing companies may carry the products of its mines and manufactories on its railroad.

Sec 5

No President, director, officer, agent or employee of any railroad company shall directly or indirectly, in the furnishing of materials or supplies to such company, or in the business of transportation as a common carrier of passengers or freight over the railroad owned, leased, controlled or worked by such company.

Sec 6

No discrimination in changes or facilities for transportation shall shall be made between transportation compa-nies and individuals, or in favor of either, by alot-ment, drawback or otherwise, and no railroad company, or any lesser manager or employee thereof, shall make any preferences in furnishing cars or motive power.

Sec 7

No railroad railway or other transportation com-pany shall issue free passes, or passanger discount to any person except officers or employees of the company.

Sec 8

No Street passenger railway shall be constructed within the limits of any city, borough or townships, without the consent of its local authorities.

Sec 9

All the affairs relating to railroads, railways and other corporations within the territory constituting this State shall be subject to the regulation of the laws of the State as may from time to time be adopted and shall at such times as may be provided by law make reports to the auditory general or to such officer us may designated, such reports shall state under the oath or affirmation of its chief officer the amount of its capital stock, its receipts and xpenditures its profits and losses and all such details as may be required by law. And the legislature shall provide the means by which insolvent corporations may be closed so that no injury may result to the stockholders.
