Wyoming State Constitutional Convention 1889

The Wyoming Constitution Convention began September 2, 1889 without the authorization from an enabling act. The articles were individually voted on, creating the final Constitution of Wyoming on September 30, 1889. It was later ratified on November 5, 1889.

Article 12 Public Officers

Sec I

All officers whose selection is not provided for in this constitution, shall be elected or appointed as may be directed by law

Sec II

Any person who shall fight a duel or send a challenge for that purpose, or be aider or abettor in fighting a duel, shall be deprived of the right to hold any office of honor or profit in this State, and may be otherwise punished as shall be prescribed by law.

Article 13 County Officers

Sec I

County officers shall be such as shall be provided by law, and in all cases where there shall be more than one person to be elected each elector shall vote but for one person and where three are to be elected, each elector may vote for two and the three persons receiving the highest number of votes at such election shall be declared elected. They shall hold their respective offices for the term of ____ years, beginning on the first Monday in January next after their election and serve until their successors shall be duly qualified; all vacancies not otherwise provided for shall be filled as shall be directed by law

Sec II

No person shall be elected or appointed to a county office who has not been a citizen thereof for six months immediately before such election or appointment if the county shall have been so long a time organized.

Sec 3

Clerks of Courts, Recorders of deeds, registers of wills, County surveyors and Sheriff shall keep their offices at the County seats of their respective counties. The compensation of all county officers shall be regulated by law to be paid in fees or by stated salaries. And the Legislature shall at its first session after the admission of the State into the Union provide by law for the strict accountability of all county officers and shall provide for sufficient bonds for the faithful performance of the duties of the respective officers and for the safety of all public monies which shall pass through their hands.

Sec 4

There shall be elected in each county three county commissioners, and three county auditors at such time and for terms as shall be provided by law and no electors shall vote for more than two persons to fill said offices, and if a vacancy in either said offices it shall be filled by appointment made by the court of the county in which such vacancy shall occur during the unexpired term of the officer by the vacancy happened.
